Aussie Teen Dodges Jail For Bashing Deaf Man

A teenager has dodged a jail term after pleading guilty to bashing a Deaf man at a Perth train station, but he will face imprisonment if he offends again in the next year, a judge has warned.



Joshua William Bignell, 18, bashed Seow Oh, 28, fracturing his eye socket, in the eastern Perth suburb of Carlisle in June last year.



Bignell bashed and kicked Mr Oh from behind as he was walking to his car parked at the station. Bignell was originally charged with assault occasioning bodily harm but the charge was later upgraded to grievous bodily harm.



On Monday, in the District Court of Western Australia Judge Phillip Eaton handed Bignell a pre-sentence order, subject to three reviews over the next 12 months. Judge Eaton decided not to imprison Bignell immediately because he was young, had a troubled childhood and mental health problems and was "now in a stable situation".



If Bignell committed an offence in the next 12 months, it was likely he'd be sentenced to an immediate term of imprisonment, Judge Eaton warned. "You can just about bank on that," he said.

"If you're going well, I'll allow the order to continue. "If things are falling apart, then I won't hesitate to bring it to an end. "If you fail, Mr Bignell, then the consequences will be grim."

HONOLULU - A young girl is forced to perform oral sex on an older boy while he films her with his cell phone camera and students at their school look on, another young girl becomes pregnant after she is raped by a male student at her school, a young boy is sodomized in the bathroom by an older student, but school administrators don’t penalized the perpetrator, another child is sexually assaulted by five boys on campus, and nothing is done to stop them or punish them after the fact.



These are not scenarios from an NBC’s Law and Order: Special Victims Unit episode, they are actual events that parents say took place at the Hawaii School for the Deaf and Blind, the state’s only public school for children with these disabilities.

For more than a decade, some of the school’s administrators and students covered up a terrible secret young children between 12 and 16 years old were being terrorized - robbed, raped, sodomized and even gang raped on campus and on the school buses – not by employees, but by other children. There are just 80 children enrolled in the school, which is located on the edge of Waikiki, Hawaii’s main tourism hub, and just across the street from the Honolulu Zoo.



One student heading a gang calling themselves the “Ringleaders” orchestrated the attacks, and students were ordered to participate as attackers or retaliated against.

HARRISBURG - A federal judge is being asked to approve a settlement of a class-action lawsuit that would ramp up the state's responsibility to individuals who are Deaf and intellectually disabled.



A key provision of the proposed deal U.S. Middle District Chief Judge Yvette Kane is weighing would require the state Department of Public Welfare to hire sign language interpreters and other specialists to improve communications with Deaf and intellectually disabled clients in the human services system.



About 250 such clients have been identified so far in the state's system of group homes and other service providers, according to filings in the case. Also, DPW would have to pay $450,000 to the Disability Rights Network of Pennsylvania, which filed the lawsuit against DPW in 2010 on behalf of a disabled client identified in court papers only as Harry M.



In seeking approval of the settlement, the rights network stated that DPW officials also have signed off on the proposed deal. The rights network claimed in its lawsuit that the state is not properly helping intellectually disabled Pennsylvanians who are Deaf, because service providers often cannot effectively communicate with them.

A new court ruling this month shows how mistakes made in assessing the applicant's medical condition can leave an employer drowning in litigation ...



Case in Point: Nicholas Keith, 22, was born Deaf and communicates using sign language. He also uses a cochlear implant that helps him detect noises, such as whistles and people calling for help. Keith received his junior lifeguard certification and then successfully completed lifeguard training. (A Michigan county provided a sign-language interpreter to relay verbal instructions to Keith during both training programs.)



Keith then applied for a lifeguard position at the county's wave pool, requesting that a sign-language interpreter be present to relay verbal directions during staff meetings. The county offered Keith the job, conditioned on his passing a pre-employment physical. The doctor failed him, citing his inability to hear. Plus, the county’s safety and risk management consultants expressed concerns over Keith being unable to do the job, despite numerous accommodations the county was offering. The Sixth Circuit has reversed the decision of a lower court and held that a Deaf individual should be permitted to proceed to trial on his claim that a prospective employer discriminated against him on the basis of disability by failing to hire him as a lifeguard. Deaf Man Charged With Manslaughter of Bus Crash Victim

DUBLIN - Deaf man charged with manslaughter of bus crash victim 'very sorry.' A Deaf man has apologised for the death of a man who was hit by a bus following an alleged roadside altercation.



Edward Connors, who is profoundly Deaf, has been charged with the manslaughter of Eoghan Dudley. The 28-year-old died last Thursday evening after suffering severe head injuries in the incident in Dublin city centre.



Connors, 29, who has been living in a homeless hostel in Dublin, was brought before the city’s District Court where proceedings were translated through a sign language interpreter.



Detective Garda Conor O’Braonain told the court that, when Connors was charged at Pearse Street Garda Station on Saturday night, he replied: “I’m very sorry about him. It was an accident.”



Judge David McHugh remanded him in custody until December 13, when he will be brought before Cloverhill courthouse.

Justice is blind, but that’s no help if you’re deaf. A suspect in a Bronx murder is trying to get his videotaped confession tossed because he says he was misunderstood and confused by a sign-language interpreter.



Following a tip, cold-case investigators nabbed Gabriel Thompson, 48, in 2010 — 25 years after he allegedly stabbed and killed a man who was having an affair with Thompson’s live-in girlfriend.



Prosecutors say Thompson confessed to the murder, but he claims the cop who interpreted his answers during an interrogation ignored his request for a lawyer and misconstrued him.



Thompson says it was also not clear to him that the person asking questions during the session was actually a prosecutor trying to gather evidence to charge him with the murder of Miguel Lopez.

Sheriff Attacks Deaf Cancer Patient in Alberta, Canada.



Must-see raw video showing a sheriff’s “unjustified” and “excessive” use of force on a mute, deaf man in a Red Deer courthouse has been released.



On Dec. 9, cancer survivor Bill Berry, 52, was paying a traffic ticket when a sheriff told him he didn’t go through the proper security screening, as he had come in through an exit door.



Berry, who is deaf, mute and breathes through his neck with a tube, tried to signal that he couldn’t hear or speak, at which point the sheriff became more forceful and tried to forcibly carry him out.



Berry collapsed to the ground and his stoma tube fell out.



He was unable to breathe until other sheriffs noticed and reinserted it.



A probe conducted by the Solicitor General Office’s Law Enforcement and Oversight Professional Standards Unit, found the sheriff, identified as Thomas Bounds, was fine to advise Berry of his error but was unlawful in physically confronting him “without hesitation.” ... TRENTON, N.J - Founder of Viable Deaf services company gets nine years for fraud. Yeh and his brother also ordered to pay $20M each. A federal judge on Wednesday sentenced John T.C. Yeh, former CEO of Rockville Deaf services business Viable, to nine years in prison and ordered him to pay restitution of $20 million for his role in a multimillion-dollar government fraud case. His brother, former Viable vice president Joseph Yeh, received a prison sentence of 55 months on Wednesday and also was ordered by Judge Joel A. Pisano to pay $20 million in restitution.



In November 2009, John and Joseph Yeh were among 26 people nationwide to be indicted for conspiring to defraud the Federal Communications Commission’s Video Relay Service program, which helps deaf people communicate, by billing the government for millions of dollars in illegitimate calls. They pleaded guilty to conspiracy to commit mail fraud in October 2010. BRIDGEVIEW, Ill. - Gary Albert, pudgier than his 1981 yearbook showed him and wearing glasses, walked out of the Bridgeview courthouse Monday night a free man, acquitted of the cold case murder of his pregnant, 15-year-old Deaf girlfriend.



Jurors who heard five days of evidence against Albert, who 30 years ago was an 18-year-old Deaf student at Hinsdale South High School, decided in less than an hour that he did not kill Dawn Niles as prosecutors had charged. “Mr. Albert, you are free to go,” Judge Joan M. O’Brien told the 49-year-old, and once the American Sign Language interpreter relayed her words, Albert looked up at the ceiling. His mother uttered “Oh dear God” and burst into tears... Seoul, South Korea - In 2006, four teachers and administrators at a South Korean School for the Deaf were convicted of raping or sexually molesting at least eight students, ages 7 to 22. Due to the country's lenient sentencing for sexual abuse, only two of the four officials served jail time.
